Scan Credit Summary

Virentia End User License Agreement (EULA)

This End User License Agreement ("Agreement") is a legal agreement between you and Virentia ("Developer"). By installing or using the Virentia application ("Application"), you agree to be bound by these terms.

1. Acknowledgement

You acknowledge that this Agreement is concluded between you and the Developer only, and not with Apple Inc. ("Apple"). The Developer, not Apple, is solely responsible for the Application and the content thereof.

2. Scope of License

The Developer grants you a personal, non-exclusive, non-transferable, non-sublicensable license to use the Application on any Apple-branded products that you own or control and as permitted by the Usage Rules set forth in the App Store Terms of Service.

3. Subscriptions and Credits

• Gardener & Botanist Plans: These plans provide a set number of monthly scan credits. Unused monthly credits expire at the end of each billing cycle and do not roll over.
• Scan Packs: Purchased "10-Scan Packs" are considered "Consumable" IAPs. They do not expire and will be used only after your monthly subscription allowance is exhausted.

4. Maintenance and Support

The Developer is solely responsible for providing any maintenance and support services with respect to the Application. You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Application.

5. AI Accuracy and Warranty Disclaimer

Virentia utilizes Artificial Intelligence to provide plant identification and health diagnostics. While the Developer strives for accuracy, the results are provided "as-is" and should be treated as educational suggestions. THE DEVELOPER DISCLAIMS ALL WARRANTIES. In the event of any failure of the Application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price. To the maximum extent permitted by law, Apple will have no other warranty obligation whatsoever.

6. Limitation of Liability

Virentia is not liable for any damages, including but not limited to the loss of plants, property damage, or personal injury resulting from the use of AI-generated suggestions or Application error.

7. Legal Compliance

You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

8. Third Party Beneficiary

You acknowledge and agree that Apple, and Apple’s subsidiaries, are third party beneficiaries of this Agreement, and that, upon your acceptance of these terms, Apple will have the right to enforce this Agreement against you as a third party beneficiary thereof.

Contrat de Licence Utilisateur Final (CLUF) Virentia

Ce Contrat de Licence Utilisateur Final (« Contrat ») est un accord juridique entre vous et Virentia (« le Développeur »). En installant ou en utilisant l'application Virentia (« l'Application »), vous acceptez d'être lié par ces termes.

1. Reconnaissance

Vous reconnaissez que ce Contrat est conclu entre vous et le Développeur uniquement, et non avec Apple Inc. (« Apple »). Le Développeur, et non Apple, est seul responsable de l'Application et de son contenu.

2. Portée de la Licence

Le Développeur vous accorde une licence personnelle, non exclusive et non transférable pour utiliser l'Application sur tout produit de marque Apple que vous possédez ou contrôlez, conformément aux règles d'utilisation établies par les conditions de l'App Store.

3. Abonnements et Crédits

• Forfaits Gardener & Botanist : Ces forfaits offrent un nombre défini de crédits de scan mensuels. Les crédits non utilisés expirent à la fin de chaque cycle de facturation et ne sont pas reportés.
• Packs de Scans : Les « Packs de 10 scans » achetés sont des achats intégrés consommables. Ils n'expirent jamais et ne sont utilisés qu'après épuisement de vos crédits d'abonnement mensuels.

4. Maintenance et Support

Le Développeur est seul responsable de la maintenance et du support de l'Application. Vous reconnaissez qu'Apple n'a aucune obligation de fournir des services de maintenance ou de support concernant l'Application.

5. Précision de l'IA et Exclusion de Garantie

Virentia utilise l'intelligence artificielle pour l'identification des plantes. Les résultats sont fournis « en l'état » à titre éducatif. LE DÉVELOPPEUR DÉCLINE TOUTE GARANTIE. En cas de défaut de conformité, vous pouvez informer Apple pour obtenir le remboursement du prix d'achat. Dans la mesure permise par la loi, Apple n'aura aucune autre obligation de garantie.

6. Limitation de Responsabilité

Virentia ne peut être tenu responsable des dommages, incluant mais sans s'y limiter, la perte de plantes ou les dommages matériels résultant de l'utilisation des suggestions de l'IA.

7. Conformité Légale

Vous déclarez et garantissez que (i) vous ne vous trouvez pas dans un pays soumis à un embargo du gouvernement américain ; et (ii) vous ne figurez sur aucune liste de parties restreintes du gouvernement américain.

8. Tiers Bénéficiaire

Vous reconnaissez et acceptez qu'Apple et ses filiales sont des tiers bénéficiaires de ce Contrat, et qu'Apple aura le droit de faire respecter ce Contrat contre vous en tant que tiers bénéficiaire.
